Hi,
My PERM was filed with one of the entries to India stay ( Outside USA ) was missed by my employer while sent to USCIS. I am on last year of my 6 year tenure of H1B and current visa expires on 5/3/2016.
However, applied H1 extension to recapture the left over ( around 4 months ) of 6 years.
My question is :- Does USCIS refer my entries from government sites ( this is correct ) OR refer what employer provided. ? Can I send correction of maxout to USCIS by any means ( via employer ? )Please help.
Constraint:- If USCIS refers employer's maxout date then I will fall short of 365 days of maxout for me to apply H1 extension based on PERM file. This will push me to out of country !!
PERM filed:- 7/17/2015
Recapture H1 ext received by USCIS:- 7/4/2015
Curr VISA expiry:- 5/3/2016
