Currently, I have encountered a situation that my lawyer said I need to apply EB3 instead of EB2 to avoid higher "Prevailing Wage Determination". For my understanding, eligibility for EB2 or EB3 should not be related to PWD... Could anyone let me know if the statement is correct or not?
Here is the statement. Since the materials engineer only requires bachelor degree, it would bring up PWD from level 1 to level 2 if used Master degree for EB2 application. I would recommend to file EB3 for lower PWD instead of EB2.
