I am in a tight spot regarding my GC. I am currently on L1-B and would be completing my quote of five years on May 2017. I had applied for H-1 last year and it didn't get picked in the lottery. Looks like this is the case this year too. The GC process is already underway and the LC would be filed soon, but I understand that I need H-1 to remain in status after May 2017. So, what are my options? I think I have to apply for H-1 next year as well and hope it gets selected? In the case that it is selected next year, can I re-claim the days I was out of the country during my L-1 and extend May 2017 by say 2 more months - and make it as close to Oct 1 2017 as possible? What about the remaining days - do I have to leave and come back?
Here is the situation from my wife's side: She is currently on H-1 and has two more years on that. Her company's policy is to apply for GC only when there is one year left on H-1. She is going to ask her company to apply for GC now. If they agree to that, would I be able to switch to H-4 and be in status even after my L1 expiry? Would I be able to continue on my current job without any break? I think this is a long shot, but wanted to get an opinion on this.
The last option is to leave the country and come back after a year with L1.
