Change Employer - I-140 Approved
Hello all,
I am planning to change my employer and I have few questions. I would really appreciate if someone can respond or point me in right direction.
I have an approved I-140 and my priority date (PD) is Dec 2011 - EB2 , and I also applied for H4-EAD for my wife. My current H1B and my wife H4-EAD expires in June 2019. I have already passed 6 yr H1B limit in 2013, now I am on my second renewal term after 6 yr limit.
Below are my questions:
Assuming my current employer is going to withdraw the I-140 resulting in USCIS revoking I-140:
1) Can I still retain my PD with new employer? Do the new job title, responsibilities & job classification need to be same as my current petition? Any road blocks I have to plan for that would prevent me from using my PD Dec 2011 with new employer?
2) Can I ask my new employer to start the GC process immediately along with H1B process and once they were able to start the PERM with my PD- Dec 2011 then I can switch? Bottom-line, How can I make sure the new employer is able to use by PD- Dec 2011 prior to joining the new company?
3) Does my wife’s H4-EAD gets revoked? Because my current I-140 will be revoked or will H4-EAD still be valid until June 2019 because I would still be in H1B status, but with a new employer.
