My husband is on L1A, which will max out in March 2018. He spent time in India from Nov 2015 to May 2016 (he was on L1B before Nov. 2015).
His company is willing to file his Green card in EB2 category. They are against filing in EB1 since he did not spend a year in India before coming to US on L1A.
My question is that can he stay after March 2018 if his GC is filed in EB2 now and he reaches I140 stage. Is there any way to extend his stay like it is for H1B visa holders who have their GC filed and keep getting extension on H1.
