Global managers while in US? (EB2 -> EB1)

    Hi,

    My employment based Green Card was filed in 2011 in EB2 category, but since then I got promoted to be manager for a team of 8 people and in addition to it, I am also managing team of 15 people in our South American country office from last 1 year. Just wondering can I re-categorize my filing to EB1 using the global managers logic?

        Were you a manager (or a Global Manager) in the same company, for at least one year, in the 3 years before coming to US? I don`t think so...because you are in the H visa and not in the L visa that is for internal transferences...Read carefully the criteria for being an intra-company Executive. This visa and GC category is used to transfer high level managers and executives inside the same company and they need to be at managerial/executive capacity before coming to US and also during their stay here. Looks like you did not arrived as an executive and was promoted later.
