My employer had filed GC application in EB1 category for me and my wife in Nov, 2017 and we had our green card interview (AOS I485) last week. I have been told that due to retrogression, the GC will not be issued prior to Oct 2018. However, my current employer has been downsizing in the US and there is chance that they might let me go prior to me obtaining the green card. In such a scenario:
1.Can I still stay in the USA while waiting for my green card to come in October. Please advise?
2.I am currently on L1A and my visa stamp is valid till 2021. My Green card related EAD is valid till Feb 2019. Would I able able to work for another employer?
3.Am I eligible to obtain green card under EB1 as per the original priority date? What are the conditions that I need to fulfill in order to get the green card?
If I find another employer within the next 60 days what will happen to my current green card petition.
My Wife is also employed in the same company and she is on a dependent (L2 visa). If I am let go then:
1.Can she still continue her in her job?
2.Would she still be eligible to stay in the US and get her GC as per the original priority date. What are the conditions she needs to fulfill
