Hello all,
As currently the Eb1 priority dates are not current - my Attorney asked me which of below options I should choose? I don't know which one is more beneficial over other.
Option 1 - File I-140 now. File AOS later when EB-1 priority dates become current. But will need to file this form - I-485 supp J - which entails additional legal fee of $750.
Option 2 - Wait until the priority dates become current again and file both phases together (1-140 and AOS). According to present regulations, etc., this would not involve the additional Supp J Form or extra $750 legal fee.
Please advise which one is more beneficial.
