from eb3 to eb2

i had my green card under eb3
now i have 5 yrs experience with bachelors degree
planning to apply for spouse visa under following to join
can i apply under eb2 now , applying with i 824 , how do i mention that i am under eb 2 now
was marrried b 4 coming to usa,but was not petitioned for my wife
