    L2 EAD vs I-485 EAD (Can we apply for both in parallel)

    We have filed I-765 (EAD) applications along with I-485 and AP applications on June 27th, 2006’ USICS received the same on June 28th , 2006 (as per the Fedex records, but we do not receipt note from USICS). Our Priority Date was current before release of July bulletin on June 12th

    I am on L1 visa, and my wife has got EAD based on L2 visa and it will be expired in another 6 months.


    My Question:
    We are not sure whether our I-485 application will be accepted / processed or not, also nobody knows processing times of I-485 applications that are being filed now. My wife doing her first year residency program, EAD is critical to her. We can afford without EAD.

    Can we apply for the renewal of her L2 based EAD, while her I-485 based EAD application is still in pending? (Can we file two different EAD applications in parallel under different categories).

    We highly appreciate expert’s advice on this. Thank you.

    Generally I-485 takes 6-8 months but with current situation its not clear.
    In my case, I am also on L1, but I applied for L2(EAD) with my I-140 and EAD was approved within 3 weeks. BTW, you applied I-485 on which category.(EB1/EB2 ???).

    I have also question. I applied my I-140 last year in June,06 approved in March,07. Then I applied for I-485 in May,07. What priority date I should consider for tracking?? Application date of I-140 or application date of I-485??
    Any idea??

        If your I-140 was labor exempt then your PD is based on I-140. Otherwise Labor filing date the application processing tracking will be based on receipt dat of I-485

          It is labor exempt. Does that mean PD is my I-140 filing date June-06??
          Now my I-485 was submitted in April-07, how do you tack my I-485??
          Based on June-06 or April-07? Or PD is not matter just processing time of I-485 which is 6-8 months or wahtever it may take.

            I am on L1A, and my filing is on EB1 category. My I-140 was filed in the first week of March 2007 (at that time we did not apply for I-485, as we were leaving US on long vacation).

            We have filed for I-485, EAD, AP together on June 28, 2007. Due to current uncertianity it is not clear about the status and timeframe of those applicaitons.

            So we are planning to apply for the renewal of L2 EAD also (It took ony 12 days for L2 EAD when we have applied in Febrauary 2007).

            My question / issue is whether we can apply both the EADs in parallel.

              did you recieve any receipt notice from USCIS?
              I have filed for I-485, EAD, AP together on June 27, 2007 but haven't recieved any notice with case # on it. Is that normal?

                I have not yet received the Receipt Notice. I think USICS taking long time due to all this confusion and high number of applications. I understad from the messages of the forum members that they are receing the receipt notes for the applications that are filed on June 20, 2007. So we can expect them in another 10 days.
