My I-140 (EB1-outstanding researcher) was approved in April 2005 and 485 was filed in Sep 2005. Got EAD and AP in May 2006. Laid off on Jan 2007 and my employer invoked my H1 (did not inform me!).
From March 2007 joined in similar job in a temporary position with company A. They put me in staffing agency B payroll who pays me hourly and gives me health insurance.
Now I got RFE from BCIS asking to submit "currently dated letter from intended permanent employer describing job duties and salary. Letter must also indicate whether the terms and conditions of your employment-based visa petition continue to exist"
Does my staffing agency consider me as permanent employee?
Can I respond with staffing firm letter? What happens to my status if I-485 denied because I donot have permanent position? Anybody has this situation? Please suggest.
