  • J1 waiver to Green card

    Hello all,

I would really appreciate your comments on my query. I am on J1 visa here in the US. I applied for the J1 waiver on "no objection" basis and recently got one (the approval letter from USCIS). I am looking forward to applying for a green card. I am not sure about the process from J1 waiver:

    1) Am I required to convert to H1B visa before applying for a green card or can I apply directly from J1 Waiver certificate (while on J1 visa) without converting to H1B?

    2) Being a recent PhD graduate in scientific research, am I eligible to apply through EB1 catergory (as that is current). I may not fall under the outstanding researcher category (as that requires a lot of publications, etc). I have a two year experience after graduating. Can I still apply on EB1 through my employer where I am working now (if he is ready to do so). I would really appreciate your experiences on this and look forward to hearing from you
