    Dear friends,

    I am completing my 6th year of H1B on Nov-15-2008. My employer filed for my Labor this month i.e just 10 months before completing 6 years.
    If my labor is pending by the time my H1B expires, then definitely I won't get one year extension.

    What if my labor is approved in next 4-5 months? Shall I be eligible to get 1 year extension?

      I not sure if this is the best way to go, but you can also apply for EAD, that may cover you for 1 more year, but just for extreme cases is the card under your sleeve. Try to cover a good contingency plan ahead of time. Good luck!

        How can he file for EAD if his labr is under processing, for EAd he will need to file I-485 with approved labo and Pd current.

        He can pray that he gets approval soon and is able to file for I-140 in premium processing. If I-140 is approved he will qualify for extensions.
