petition/Application for Work Permit, SSS,ETC

I was petitioned by my american husband sometime in Dec 07. My work permit is still pending to now. My . We got married in Oct 07. We were not aware of IRS ruling, We stated as single. in 2008 Income Tax Return..
Would that have an impact on his pending petition to me and my application for work permit as well. .
Need your help on this. Do INS look on this filing status ?
