  • Travel immediately after I-485 is filed

    My I-485 is scheduled to be filed during september first week. I am planning to travel to India in October. Does this in any way affect my I-485 application?

    You can not leave the USA without an approved Advance Parole document (i-131) or with a valid H1/L1 visa. Otherwise your I-485 will be considered abandoned.

      I have a valid H1-B till 2010. Also, at the time of I-485 application does it require my wife to be present in US (if she needs get added to 485)?

        Yes, if it is AOS, the person has to be physically present in the US.
