    Hi,

    Currently I am in H1 (around 10 yrs) valid still marh 2010 and have EAD till July'2010 & 140 approved year ago , I-485 filed and pending (EB3) for approval but since i got recently married, I am maitaining H1 to continue my wife ( In usa now) in status which is on H4 now.

    Here are my question as below.

    1. if i change my job to another employer with My EAD , Is my wife loosing the status ?

    2. If i change my job to another employer with H1 transfer (since i have valid H1 now) but joining using EAD w/AC21 ? what would my & My wife status?

    3. If i change my job to another employer with H1 transfer but joining H1(also maintaining the EAD status) , what would be the status My wife ?
    will it impact my 485 approval anyway?

    it would great if any one reply back to the above !!

    1. Yes. You need to always remain on H1 for your H4 to be in status and not use EAD or AP until you have her 485 filed.
    2. #1 answers this. If you have the H1 transferred, use H1 and do not use EAD. AC21 for using your new employer as your GC sponsor has to be done and the job to remain the same as your labor filing for the GC.
    3. You do not seem to get or understand the difference between H1 and EAD use. If you are using H1b, what do you mean by EAD status? There is no status called EAD. You are a parolee if you use EAD.

      Thanks with referencet to your answer for Question 2, if i use the H1, still i can file 485 for my wife when it becomes PD current? or i loose my GC processing ?

      For Question 3 : What i am asking here is even changed my job with H1 transger, still i am eligible to extend the EAD ?

        If your GC is pending for more than 180 days and I140 is approved, you are sort of a free bird with AC21 as long as your new job is same/similar to your GC job.

        H4's GC is dependent on YOURS!!! Not any employer. Yours is based on employment. So, as long as you meet the A21 regulations and your 485 is pending, you can add your spouse as a derivative when your PD becomes correct.
