  • GC processing and gap in employment

    Hi All,

I have a H1B visa and my I-140 has been approved and I'm now waiting for the priority dates.
Till date I've have had continuous employment.
Now it looks like I'll be laid off and in this market I'm not getting any job offers. So it looks like there maybe a gap in employment.
I was told that any gap in employment will affect (or raises queries) during GC processing.
But I also read that according to 245(k) rule I could be without a job for 180 days without affecting my GC processing.

Pls let me know if my understanding of the rule is correct. Also under what conditions will my GC be affected if there is a gap in employment

    Thanks
    Mina

An important piece is missing: Did you file I-485 and 180 days have passed after filing I-485?
