Recently my employer approved my business case for Permanent Residency (Green Card) process. I provided required documents to Employer's Law Firm. I just had a talk with them about the process and the category in which they are going to file my PR application.
They told me that they are considering me for EB3 category instead of EB2 Category. They gave me a weird reason that I don't have 4 years of Bachelor Degree which is not true. Here is my background.
I have done 10th from Maharashtra State Board of Secondary and Higher Secondary Education. Then I did 3 year Diploma in Engineering from Board of Technical Examinations Maharashtra State. After doing diploma, I got directly admitted to 2nd Year of Bachelor of Engineering Program (which is a 4 years degree program) in one of the premier institute in Mumbai under University of Mumbai. Many people do 10 + 2 + 4 to get Bachelor of Engineering Degree, in my case it is 10 + 3 + 3. Because of this they are saying that they will not file my application in EB2 Category. I told them that I attended a 4 Year Degree Program which allows direct admission to 2nd and it is equivalent to any BS in Engineering Program in US.
Based on this, they told me that they will do my educational credential evaluation once again and based on that result, they will decide the category. I am fulfilling all the other criterion of EB2 category.
I will appreciate your responses for below questions:
1. Is someone encounter this kind of scenario?
2. If yes, how did you handle this situation?
3. What are the documents or justifications you provided to make your case for EB2 category?
4. Even after giving supporting documents, what was the final category in which your employer filed your Labor?
5. Even if you haven't encountered this kind of situation, can you please guide me on how should I best handle this scenario?
I really need your help and guidance. It's being quiet a roller-coaster ride for me. Any help is appreciated.
