    My current immigration status is H1 B(2nd year) and Indian Nationality and have an approved I140 from employer A. I have a job offer that I am pursuing with company B, a fortune 10 client and need your help addressing the questions below as soon as you can.


    1. I have an approved I140, EB2 category. Can my company B directly transfer I140?

    2. Can company A revoke Labor and I140? what if company A revoked my I140, how would it effect my GC status.

    3. To use the existing priority date, does my new perm with company B have to have the same job description or any other rules apply?

    4. Do I really have to have reference letters from my previous employers prior to having PERM applied?

    5. What are all the risks that I need to know if I am switching to employer B after I140 is approved through emp A.
    Any workarounds or ideas to combat?

    6. Company B will submit a request to transfer H1, will company A know somehow that my H1 is no more active with them?

    7. Once my new H1 is approved, do I have to terminate immediately with company A or is there a lead time?

    8. I heard that if I transfer H1 from company A to B, status of H1 with employer A after the transfer still on uscis website shows "approved". What does this mean? can I go back to emp A with ease if I have to in the future?

    9. Is there a premium processing for I140 and I485?

    10. Can I do a concurrent filing for I140 and 485 when my priority date is reached?

    11. Can company A file for I485 when current though I am working for company B during that time? Do I have to work for A atleast after 485 is filed approved/processing?
