  • Different situation of GC

    Hi There,

    Need your expert inputs here.

Company A (American Core Company) holds my H1 B. It is set to expire 10/10.
Their policy doesnt allow for filing GC to employees at my role and visa.
They definitely want me to continue and can provide all the necessary letters. They asked me to check if some other company can sponsor my GC.
I have spoken to company B who mentioned that since the time left on my H1 is very less they cannot do a H1 Transfer but can file a GC. So Company A would be my H1 B sponsor but Company B will be my GC sponsor.
I can go post questions to the legal dept of my company A but it takes few weeks for even simple questions for them to get back. Hence I am posting on this super helpful forum to have some direction.
Q1 - Is this possible. (I read in one (just one related thread) that this can happen)
Q2- Let's say Company B applies for GC (EB2) in March. I know the process involved so I can clearly see that it could be a case where even the Labor might not be approved by Oct 2010. What is the situation then? Can I get H1 B extended (by one year) based on the labor application of Company B? I am guessing not.

Any insight to the above situation will be really helpful.

    Thanks in Advance
    Cheers
    Adi
