currently on l1b ... whether eligible for eb1

I m a manager in a software company . I m currently in USA from 15 july 2007 on l1b before that i was in India for whole one yr. now its like 2yrs and six months since i m in USA . my concern is whether i m eligible for eb1 categary or not if my company apply for my gc as there is rule that u should be out of country for one year from the last three year for eligibility in eb1.

Generally, EB1 applies to L1A and NOT L1B.
