    Hi all,

    I have a question need your help. On the 15th Oct, my husband attended to the interview with USCIS and got the approval of GC on spot (EB3), but my son and I still live in home country. The I140 including me and my son has been approved in April 2019. Now I am wondering if my husband will start the process of sponsoring us by EB3 since our I140 approved or we need to change to F2A (green card sponsor spouse and children). Do you guys know how long to sponsor spouse and children by EB3 or even F2A? The visa bulletin for both are now current.

    He should file I-824 to move the approved petition to NVC for consular processing for you guys to follow to join. He does not need to petition you guys separately in F2A.

      I don't know how I managed to delete my post instead of making an edit to thank newacct for confirming that, with I-824 you will continue the EB3 process for you and your son via consular processing and will not be F2A. Good luck.

        hi , thanks a lot. I just found out he should have submitted form I824 with I485 together, but he didn't. Now he just starts submitting form I824 after getting GC. Do you know that the timeframe to approve I824? If we submit now, does it take longer for approval than submit together with I485?
