I am currently working on H1B (Out of Cap). My labor was filed in 2012 under EB3. My I140 got Approved in 2013. My EB3 Priority Date is in Feb 2013.
My job qualifies for EB1 now but my Employer is not ready to file EB1 because of their internal employee GC filing backlog. Can I port my filing from EB3 to EB1 through an Immigration Attorney, instead of waiting for my Employer to initiate it.
