Please guide for merger question

Hi,
I have Masters degree and working as full time employee. I have applied for Labor certification in EB2 category as company needed master's degree. My Labor got approved and now I am waiting for applying I-140.

Now, thing is: My company merged with a big company and that company's lawyers and HR took over my case. The job that i have been mapped to in this new company don't need Master's degree. They just need Bachelor degree for the job they have mapped me in.

So question is: IS this an issue since my labor has already been cleared in EB2category due to my original job requirement (where they need Master's degree )and now i have to apply for I-140 with job that doesn't need master's degree (my need job description in new company that overtook our company).

PLEASE GUIDE.

What is your experience.
If ur job requirement states Bachelor, then u will come under EB3 category.

Please remember that the future document will most likely been filed by your company under the New name or also as DBA ( Doing business as....).

Also remember that any point in time they can request a RFE asking questions on the company's requirment on the Job... sometimes they question as soon as they see a change / Merged / Layoff in the news.

Few years ago when my company has Layoffs.. all pending GC's were sent RFE and the company was unable to justify RIR and moved few case to regular GC causing additional years of waiting.

As the Attorney who has the case.. they will advice. Note GC Job is always in the future so they can question at any time including at the interview if that position and requirment still exists.
