  • Birth Certificate for GC Processing

    This is regarding the Birth Certificate requirement in Green Card processing.
    • First of all, in which stage of GC processing the birth certificate will be required to submit.
    • Secondly, I don't have a birth certificate from the municipality in which I was born and neither do I have a certificate from the hospital from where I was born. I do have all other documents which shows the Birth date lie Aadhar, PAN Card or Voter Card.

    Any suggestion how to get the birth certificate. My GC processing is going to start in next 2 months time.

    Please see my answers below.
    First of all, in which stage of GC processing the birth certificate will be required to submit.
    Answer: You will need to include birth certificate when you file I-485 Adjustment of status application.
    Below is birth certificate requirement when you file the petition with USCIS.
    A copy of the applicant’s foreign birth certificate or sufficient secondary evidence of birth must be submitted to establish the applicant’s country of citizenship for visa chargeability, identity, and existence of derivative relationships.Each foreign birth certificate must include a certified English translation.
    Officers will check the Department of State's Country Reciprocity Schedule to determine availability of birth certificates as well as acceptable secondary evidence of birth for specific countries.

    Answer: Normally birth certificate must be issued by the concern government agency or civil authority. And it includes,
    1. Full name
    2. Date of birth
    3. Place of birth
    4. Full name of both parents
    5. Name of issuing government body
    6. Date of issuance
    7. Seal or other certification along with signature.
    If the birth certificate is not meeting above requirements then you can consider providing secondary evidence which is also acceptable.
    I can list out below secondary evidence which will help you to understand and proceed ahead.
    1. Affidavit from relatives
    2. certificate of Non-availability
    3. Hospital birth records
    4. Medical records
    5. School records
    6. Census records
    7. Church records
    8. Other legal records such as voter ID, PAN card, passport copies, Driving license, Aadhar.
