  • I140 revoked

Hello, My I140 was approved in 2007 and I485 was applied in 2007, and has been pending since then.
I have been working for the same
Employer since then. We received a NOIR earlier this year but my employer was unable to provide all the required documents listed in the NOIR.
Hence, USCIS revoked my I140 on August 6th 2021. The due date to file the appeal is October 3rd 2021 but my employer doesnt want to appeal so the I140 stands revoked.
My question is, tentatively when would my Adjustment of status be denied? How long after that would we have to leave the country , before removal proceeding is initiated?
We have begun wrapping things up here, but a timeline would help.
An attorney suggested that we can file a substitute petition or self petition, but as per my understanding that is for extraordinarily talented people in the field of science, arts or sports. Not sure if that can even be an option for me, would anyone have an idea on what that is?

This is terrible. Why isn't the company appealing? You're been in the US for like 14 years, is there no other visa category they could seek for you?

If I485 has been pending for 180 days and employer revokes I140, I know the 485 isn't auto denied. I wonder if that provision carries over to a USCIS revocation too

    Good luck

I am sorry about your situation. It is difficult to have I485 approved if i140 is revoked. The entire application basically hinges on the approval of i140. i485 is mostly a formality.
