H1B -5 yrs... return back in L1A.... EB1 Eligibility
Hi -
I was in US for 5 years on my H1B in a well reputed consuting and technology company as a Manager. Applied for GC in EB3, Labour cleared, 140 cleared. During an audit from Immigration dept, client letter was requested but client refused to provide so I need to head back to India. Now I am working in the same entity at India.
I have two options, come back in H1B again (client agreed to provide client letter) or stay in India for a year, apply L1A and go back to US and process GC in EB1 category (L1A manager/ executive)
1) Will there be any issue if I apply in EB1?
2) Should I come back in H1B or L1A?
3) Is it safe to continue my current GC on H1B or L1A EB1 will be a better move?
4) Heard EB1 is a tuff shell to crack for IT professional - Is that true?
5) L1A - EB 1 application says I need to be in US for 3 yrs so can I use my H1B period for my eligibility or should I wait for 3 years to complete in L1A?
