A partner and I started an LLC based out of CA. I need an immigration advice for my partner
His priority date is Nov 2012 and has an approved EB2 and applied for AOS in Oct 2020 with Downgrade to EB3.His EB3 is still pending but he got his EAD/AP earlier this year. He filed for 485j in Feb of this year.
He started an LLC as a owner and we are in progress to add me to the company as a co-owner and we are going operate as a C Corp
His employer is not cooperative in immigration matters so he would like to work under the new LLC we are forming.
What are his options from here on w.r.t. AOS?
Can he stop working for the current company and use his EAD to be in the new company or is it advised to continue with the company till green card is in hand? Can we file a new 485J from the new company invoking AC21?
