    Hi There,

    I read on immihelp that for the perm , the wage offered must equal or exceed the prevailing wage and the 5% deviation is no longer allowed. Does it affect the category (EB2 or EB3) in which the perm can be filed given the fact that the job description qualifies for EB2? My case is such that my job description is eligible for EB2 but my salary is between level 2 and level 3. My salary is 11% more than level 2 and 6% less than level 3. Can the Greencard be filed in EB2?

    Possibly if you can make up for the gap in pay by the time you get the GC. Remember, GC is for future employment and so is the labor.

      Thanks for the prompt response. Really appreciate your input. I got what you are saying but need a small clarification. The wage level are in Level 1 , level 2 , level 3 and level 4. Whats the ideal level for EB2? Does the O*NetJobZone matter too? In my case, O*NetJobZone is 4.
