Master with 8 yrs exp, wrongly filed in EB3, employer says i need to pay to change

I have masters degree with 8 yrs experience, employer has started recently only to file my GC, when i asked the lawyer he told that my employer has asked him to file in EB3, but i am eligible for EB2, now when i ask them to change from EB3 to EB2, they say that

"We are already well into the EB3 processing of my green card.they will continue with the EB3 processing.

If i want to file a second case under EB2 they will do that but i will have to pay all costs of the second case."

i am confused , it was their mistake to file it wrong, and also they are in the step like giving the advertisement for my position only.

Green card fee is a matter between you and your employer. There is no law one way or another.
