I recently joined a Company as the Corporate Controller. I did my B.Com(Hons) (3 year bachelors) from India and completed my Chartered Accountancy (CA), after which I did my CPA in US. I have over 5 years of progressive managerial experience in the same profession. When I applied for my CPA license in 2007, I got my foreign education (B Com (Hons) + CA) evaluated and was considered to be a U.S. Bachelor's equivalent. My 6 year H1B period expires in October 2012, and my understand is that my PERM needs to be filed atleast 1 year before my H1B expiration (Oct 2011).
Questions -
Am I eligible for EB-2?
Is there a risk that USCIS would deny EB-2 on account of not having an equivalent US Bachelors? If USCIS denies EB-2, I'll have to then leave the country as I wont have enough time to re-file under EB-3.
