I’m sure many have had this question. I am currently working on an H-1b visa, with my 6 year period expiring on 9/30/2011. My Green-card application process is in order and I have the PERM & I-140 approved. Based on the I-140 approval, my current employer’s attorney has filed an H-1b extension petition for 3 years. The priority date for my permanent residency application is September 2010. Appreciate your thoughts on-
1) Granted that my extension petition is approved, I may switch employers based on an H-1b transfer and still not lose my I-140 approval status?
(I realize that the new job should be commensurate with my work experience included on the I-140 petition)
2) My new employer should assist me with my I-485 application once my priority date is current. If this doesn’t happen within the three year extended
H-1b period, an H-1b further extension request can be made?
