EB2 Elgibility with BCA + MS equivalent to US degree?

Hi experts please advise me on my case,

I have following degrees and experience in IT.

Degrees
1) Bachelor of Computer Application (BCA) 1999 - 2002 - 3yrs - Regular
2) Master of Computer Science (Msc) 2003 - 2005 - 2ys - Distance Education

Experience
1) Company A July 2002 - Oct 2003
2) Company B Oct 2003 - Mar 2008
3) Company C May 2008 to July 2010
4) Company D July 2010 - Till date

My current employer D is saying I am not eligible for EB2 category because I don’t have US equivalent bachelor degree. I have checked below Immigration site which says 3 yrs. degree + 2 yrs. master degree can be equivalent to US bachelor degree. Is this true ? Can we combine 2 degrees from India and that’s automatically equivalent to US degree.. Is this possible ?. If you can you please send some site reference other than below, so I can forward the same to my employer as reference and discuss with him.

Assuming my Job says it required BS + 5yrs requirement.

Please help me!!

It will be difficult to get the 140 approved. Research and read through stories of people with similar backgrounds and I140 rejected available on the internet. Not impossible as people have gotten approvals in the past but getting more and more difficult.
