Question: If I-485 gets rejected, would I be able to port the priority date while doing new GC process with different employer? Here is more details about my scenario.
Employer A --> Previous Employer - I-140 Approved - Waiting for PD to be current
Employer B --> Current Employer - initiated new GC labor but still awaiting to file the labor
My Labor (EB2 category) and I-140 has been applied by Employer A and it is approved.
Currently I am working with Employer B as my H1B stamping went into 221g administrative processing with Employer A. I have initiated a new GC process with Employer B and yet to file for the labor.
If the PD becomes current, I am planning to file my I-485 with Employer A while still working with Employer B. Given that, if my I-485 from employer A is rejected, would I be able to port the date in my new GC process when I reach the I-140 stage with Employer B?
