  • EB1 Filed, now my job is changing

    hi all - I came to the US on an L1-A visa earlier this year.

    My company has applied for a green card on my behalf, category EB1, multinational manager. Application was filed in October, I am waiting for my I-140 to be issued. This should hopefully happen by end February (maybe that is optimistic ).

    My current role is being eliminated as a result of restructuring, and my company has offered me an alternative role. This would involve relocating from New York to LA, and switching to a different business area. I would continue to have a managerial/executive role, though my day to day responsibilities would be different to the job I had when my employer made the original GC application.

    I have the following questions, and would be enormously grateful for any advice:

    1. does it make any difference to my current GC application if: (1) I relocate from NY to LA? (2) my responsibilities change (whilst I still continue to be managerial/executive employee)
    2. is the answer to either of the above different if my I-140 is approved before my location or responsibilities change?
    3. if I decide to take a job with a different employer, I assume that ends my current GC application. Does that change if I stay with my current employer until I get my I-140? Once the I-140 is issued, is there a way I can pursue a GC myself, or with a different employer, or must I remain with my current employer thru the adjustment of status phase?
    4. any recent views/experiences on length of time to obtain a GC via the EB1 route?

    you have filed ur application in oct and expecting an I140 by feb end...
    Not sure whats wrong generally EB1s are approved in 2 -3 months time...

    Right from 140 to I485....

    EB1 is a very rate category and ur one of the lucky ones to be there so please dont even think about moving out of your company.....
    Get ur GC wait for 6 months and then move on if you want to
