GC priority date is current and wife's H1 visa is pending with 221g

Hi,

I came to India for H1B stamping and got stuck with 221g. Now my husband GC priority date is going to be current. Can he still include me in his I485? Does he need my visa for filling me along with his 485. Could anyone please clarify me on this.

Your visa is not needed however, your physical presence in the US is needed. In turn, it translates to you needing your visa to get into the US.

Could you please let me know the options that I have now ?

- Can I apply for H4. If so, what are the chance of me getting H4. Does my H1 get revoked when I apply for H4

- Can I be include using consular processing.
