I am currently on H1B (sixth year) and my current company has decided to file GC and are in pre-labor steps. I am hoping to get 3-year H1B extension before the end of 6-yr period.
The problem is I hate my job and would like out to it as soon as possible, but no other employer would be interested in hiring because of expiring visa. My current employer has changed my job description and filed my case is SOC category which I DON'T want to be in. I have decided to be patient till I get 3-yr extension and then try for job change. Now the question is:
Can I transfer my H1B extn with new company, even if SOC code filed in I-140 is different from the new job that I would look for.
1. If yes, can I keep the PD date from previous filing
2. If no, can I change job profile after waiting till I-485 filing + 180 days
The issue in my case is change of job profile.
Please Advise. Any help would be highly appreciated.
