I had initiated my PERM request with my employer and submitted all the necessary documents. When I checked the status of the filing with employer's immigration team after seeing no activity on the company's internal website, they mentioned that they cannot file any PERM application now due to DOL mandated recruitment phase. We do not have a definite timeframe of when we would start the filing. It is pending with DOL for prevailing wage.
I am on H1b and my max date is April 14, 2013 that is one year from now. I am worried as I see trouble with my continuity in this country as I will be short of labor and other critical processes.
I wish to know how long this DOL mandated recruitment phase will go on, and what are my options. Should I wait for this mandatory phase to get over or switch to a different employer and proceed with my filings.
