I have a couple of scenarios I needed help on. Any inputs provided will be greatly appreciated.
1. I have an approved I-140 in Eb2 (PF Sep 2007) with Company A. If I move to another company B for EB2 portng and get a 3 yr h1b extension, can I move to another company C and still retain my priority date of 2007?Can I do this in any of these scenarios?
- company B has started my green card proces and I-140 is approved and 2007 priority date has ben ported
- company B has not started my green card process
- company B has started my green card process and labor has been filed but not I-140
2. If my current company A does a Eb2 porting, and the I-140 gets denied, can I still use the priority date from my Eb3 application with another employer B?
2.a. Is it better to port the priority date at I-140 stage or I-485 stage so that if I140 gets denied, I would still have the option of using the Eb3 priority date with another employer?
