  • Opening a company (LLC) on EAD card

    Hi,

    I am currently on H4 and planning to open a LLC company. Could you please help with the following:

    i) Can I transfer from H4 to EAD, while my husband is still on H1?

    ii) What is the process of transfer from H4 to EAD, if I am opening a LLC company. I would be the sole owner of the company and will not be drawing any salary from this company.

    No, You can't open any LLC company once you are on H4. What does H4 Transfer to EAD means? Sorry, there are no any criteria like that with USCIS. Your H1B spouse will get EAD same time you also get same status of your H1B spouse after that you can open a company.

      - Did your husband have any pending AOS. ( I-485 pending but EAD is issued and valid)
      - Are you a derivative of your husband AOS application. (Did you have EAD?)
      - Did you have social security No?

      if yes to above then you can open a company.
