Hello Everyone !
I am currently on EB3, working at a financial firm for last 8 years. I got promoted 1 year back as a manager. I asked my company if they could apply for conversion from my EB3 to EB2 for which they finally agreed after much delay, and authorized company attorney to proceed.
I have MS and 2 yrs experience before I started at the firm so per as attorney it would be simple case, but there are couple of things attorney said, which totally confused me !!
1) My experience in the firm (8 years) could not be counted, so I have to get new experience letter from my employer 8 years back, having job duties of manager, my current job. How is that possible? esp I already submitted one set of these letters during my EB3 H1 filing.
2) They sent me a form asking me compare my old job duties with my new job duties as manager, to put percentage of time spent on each skill. when I asked for explanation, they said, 'we want to make sure there is NO overlap between your new position and old position, as we can not use experience you gained from old position. Again, if I am working at the firm for 8 years, and if I get promoted, where else will I get experience for next level??
I am very confused if my attorney (BAL) is helping my case or making it worst !! My EB3 date is July 2005, and getting EB2 will save me at least 4 years to get GC.
