    My daughter's father is a US citizen. My daughter & I are British citizens living in the UK. We would like to join him in the US. What are our options?

    1. Apply for permanent resident for my daughter?
    2. Apply for fiancé visa for myself?
    3. Both of the above?

    My US partner (father of my child) does NOT want to marry me. He suggests applying for my daughter to get the green card & then later apply for me to get my green card on the basis of my daughter's green card.

    If I come in on a fiancé visa, how long before I would have to get married to the father?

    Your partner can file a petition for your daughter, which allows her to move to the US using an IR visa. The condition is that your daughter isn’t married and hasn’t turned 21. In order for your daughter to file a petition for you, she has to be a US citizen and at least 18 (or maybe even 21) years old. Your daughter won’t be able to sponsor you as a parent if she only is a LPR. Normally it takes at least five years of physical presence to obtain citizenship.

    If you decide to use a K1 visa, you have to get married within 90 days of entering the US. Your daughter could apply for a K2 visa at the same time, provided that she is unmarried and younger than 21. Another option would be the IR-1/CR-1 visa, but that would require you to be married.
