The rule is that the primary beneficiary of a petition MUST enter the US with or before the derivatives.
So if your father has already entered the US on his visa then you as the derivative can now enter the US at any time as long as the visa is valid.F3

Yes I'm sure
I hope you understand what I am about to write.
Beneficiaries of a petition must be the first one to enter the US. Most derivatives enter at the same time with the beneficiary but a few enter another time by themselves. Your problem was that you were supposed to go to the US with your father but there was an issue with your visa so daddy used his visa to enter the US and then got his greencard. Now your visa is fixed and you want to leave. You can do it anytime you want, by yourself as long as the visa is valid. Immigration at the airport will have your father's information (when he entered and what visa he came on) in their computer system. They already know he has a greencard and is in India so you don't have to bring anything of your father's with you.
If you want to bring a copy of your father's greencard to ease your mind then do it but it won't be necessary. If you don't trust what I'm saying EMAIL the immigrant visa (IV) unit of the US CONSULATE/EMBASSY in New Delhi or Mumbai. In that email make sure to include your case number, petitioner's name, your father's name and tell them what happened to you. Ask them if you can go to the US without your father and if there are any specific documents you need to carry with you to show airport officials in America.Last edited by aaydrian; 12-30-2012, 11:00 AM.F3
