  • Basic, High Level Questions on Marrying a US citizen

    ME: H1B Visa
    Her: US citizen

    1) Is it ok to marry and apply for my GC even if we live in separate states for the next 10 months? I am in MBA school and graduate in Dec.
    2) How much time does it take to get the temporary green card? Assuming we get married in May and file the papers end of May/June.My H1B expires August 23 2013. Should I reapply for renewal?
    3) What additional docs do we need to get an EAD (along with temp green card) so that I can keep working past my H1 expiration?
    4) Can I travel internationally on temp green card?
    5) Can I work on temporary green card?
    6) Since we live separately, should we mention the reasons why we are living separately in the I-130 form we send out? I am referring to the one page essay we write about how we met/dated, etc?
    7) Other than joint bank accounts, my wife's name of my apt lease, joint credit card account, anything else you recommend?

      1. Living separately doesn’t prevent you from adjusting status, but they might ask about it during the interview.
      2. Some service centers are currently processing I-130 applications from May/June 2012. The processing time for I-485 is around four or five months. I’m not sure how fast it goes if you file I-130 together with I-485. Also, you should check what happens when you file for AOS from H1B. Usually you go into pending status and leave your previous visa status, but I’m not sure if that’s the case with H1B.
      3. Except for filing I-765? I-765 is normally approved within three months which would allow you to work.
      4. Yes, if you’re referring to the conditional green card.
      5. Yes.
      6. What essay are you referring to? The I-130 doesn’t mention it unless I have missed something.
      7. Joint health insurance, joint car title, affidavits by other people who know you.
