I'm a green card holder and my wife is not. I've applied for my wife's green card through family based processing. Initially we thought it would be safer do pick consular processing option. If things keep going the way they are then our priority date should current soon. As of now, she is in US on L1B and wouldn't be able to travel to India for consular processing. Hence we made the decision to go with AOS and notified NVC via email that we would be doing the same.
The plan is once the priority date becomes current we'll apply for AOS. The few open questions we had were,
- Would I need to provide Affidavit of support document again. I'd submitted those to NVC already. Would they be returning those to USCIS once I apply for AOS
- How long of a delay we should anticipate due to this switch from consular processing to AOS
Please help me understand the process better and share any of your experience on this matter. Thanks for your help!
