Do I require filing I-765 & I-131 Forms?

  • Do I require filing I-765 & I-131 Forms?

    I am a Canadian citizen currently working in the US on a TN work permit (Computer Systems Analyst). I will be getting married to a US citizen in October 2013 and shortly after that I intend to apply for a family based greencard. For the I-465 form I see there is an accompanying I-765 for work authorization and I-131 for travel. If my current TN work permit is valid until February 2016 do I need to worry about either of these documents? Should I be able to travel freely between the US and Canada as I do now while the I-465 is being processed without filing an I-131? And will I also be able to continue to work as a Computer Systems Analyst as I do now without filing the I-765?

    I am in the exact same situation. Also Canadian citizen and just got married to a US citizen.
    I am also not sure about the need to file I-765 and I-131

    If anyone knows please advise.

      Just found out the official answers to this question.

      Yes we do need to file I-765
      and you need I-131 if you are planning to travel outside the US during the time your adjustment of status is being processed.

      If you are on a TN-1 visa and you apply for permanent residency you are no longer able to travel until you get your status changed OR you have received the Work and Travel authorization card that will come 90 days after filing the entire package (I-130, I-485, I-765 and I-131) also since you are applying and paying for I-130 and I-485, the fees for I-765 and I-131 are included in I-485 so it only makes sense to send them all together. That way after about 90 days you can travel and work while waiting for your interview

          I have the same question. I am applying for I-765 and can't seem to figure out my Eligibility Category given my TN status. It seems that the Employment-Based Non immigrant Categories are most applicable, however none of the subcategories apply to me
