Family based GC (L1A on EB1)

Hi,

My spouse is on L1A and should be able to apply for green card on EB1 in sept 2013. I am working on L2 with EAD. I have the option of applying for an H1 visa through my employer - if I do that does it impact the processing time for the green card.

As far as my knowledge goes green card processing for L1A on EB1 can be significantly less that H1 visa holders. If I throw that in the mix does the spouse being on H1 change the processing time for the GC of the L1A visa holder (The L1A will be the primary on the GC application).

Your spouse get apply for his green card on L1A in EB1 category.

You can apply for your I-485 along with him. Both of you will get green card at the same time.

Your being on H1 visa is irrelevant and will not cause any problems.
