priority date is current what to do now?

  • priority date is current what to do now?

    i am a doctoral student married to US permanent resident. On her basis we had filed I-130 in JAN 2011 and it was approved and we were to wait until priority date was current. In May Visa Bulletin the priority date shows March 2011.

    What should we do now? Do we send I-485 and other forms or wait to be contacted from USCIS?

    Also, my wife may be eligible to file for her naturalization in May. Do we wait or just go through the AOS process for right now and then just send her certificate later on?

    Please, any help is appreciated.

    You are not current. The VB that is out is for May which means you will not be current until May 2013. Between today and the 1st week of May, you should get packet 4 (your interview letter) from NVC. Packet 4 will instruct you on what to do. If that doesn't happen, keep emailing your local embassy until you get that packet.

    Since your wife qualifies for citizenship in May that means she has to submit her application, wait 7 months to be interviewed then wait another month to be sworn in and get her naturalization certificate. By then if you're out side the US it would take one more year for your spouse to petition for you (IR1) while if you adjust status in the US then it can take 3-9 months to get your greencard. So if you wait until your spouse is a US citizen it will take almost 2 yrs for you to become a permanent resident.

    Where did you elect to have your interview, in the US, your native country or the country in which you currently study?

      Currently I am in Beaumont, Texas.
      I elected for USCIS processing and adjustment of status, if that's what you asking for.

      Also, as you said I would be getting a packet 4 from NVC. Does it mean that they would ask me to send my AOS packet after I receive that.

      As you say it would be better to apply for adjustment of status as soon as I receive packet 4 than to wait for my wife to become citizen to apply. right?

        Yes

        I don't know if packet 4 for family based AOS is different from packet 4 for those who interview outside the US so I can't tell you exactly what to expect. The best advice I can give is the packet you get will tell you what to do. Don't be surprised if you're asked to submit/carry to the interview an affidavit of support and medical; you might have to provide fingerprints (for background checks) via a Biometrics appointment.

        Yes. As long as a visa number is available and you're F1 visa is still valid (you're not out of status) go ahead with the F2a option.
