  • Help Please! Greencard for parents and brother!

    Hello all,

I need someone to please guide me through the right steps. I will be a U.S. citizen by end of May 2013 hopefully. Now, I have my parents and younger brother (16 years old) waiting to immigrate from India. They currently have valid visit visa until 2018. I was told to apply for parents first through I-130. Can I do that right after I get my passport while they are still in India? How does the adjustment of status come into play? I am really confused please help!!! I was thinking of filing I-130 for parents...have them come here for biometrics...then have them again for interview...thats like 2-3 trips within 6 months! Please help! What is the safest fastest way for me to get my parents and younger brother to immigrate to the US of A?

    Option 1
    -Naturalize
-File I-130 petition (one for each family member)
    -Sit & wait
-In 1 year both parents interview and leave for America; son/brother is left behind
-By a minimum of 12 yrs brother interviews and leaves for America

    Option 2
    -Naturalize
-File I-130 petition (one for brother and ONE for parent of choice)
    -Sit & wait
-In 1 year that ONE parent interviews and leaves for America
-Parent who is now a green-card holder files for son and spouse under F2A category
-In 2.5-3 yrs spouse and son interviews and leaves for America

    Option 3
    -Naturalize
-File I-130 petition (one for each family member)
    -Sit & wait
-In 1 year both parents interview and leaves for America
-Choose a parent to file for a reentry permit for them self and have that same parent go back to India
-Have either parent file an I-130 petition for the son
-Sit & wait 2.5-3 yrs for son to interview and leave for America

    Option 4
    -Naturalize
-Have your parents visit you with intent to adjust status
-File I-485 form (Adjustment of status application)
-Congratulations, you've just committed IMMIGRATION FRAUD

People can't adjust status through their siblings
A US passport, US birth certificate or Naturalization certificate can be used to file for family
You can have as many petitions filed as you are qualified for
It's best to have as many petitions filed as you are qualified for as insurance/a back up plan (in case one petitioner dies)
As a green-card holder you can file for qualified family as soon as you enter America (which can be the same day you immigrate)

    Yes
    See 'Option 4'
Not possible. Once you've filed to adjust status you have to stay put until/unless you have advanced parole
