  • F4 CSPA approved

My parents were interviewed in Feb this year and the consular officer had approved the CSPA for me and my brother as well. We will have an interview in June. The problem is, my brother doesn't want to immigrate to US now. But, we are fearing that not doing so will negate any future chances of him getting even a tourist visa as he had applied for an immigrant visa before. What is the best way that this situation can be tackled with? Thanks in advance for your help..

What's the reason why he doesn't want to immigrate now ? Anyway what he should do is just land on US soil, then apply for reentry permit (this is good for 2 years). He can go back to your country and stay outside the US for 2 years without losing his LPR status. Then he has to go back to the US before the expiration of his reentry permit.

If your PD becomes current before you become 24 years old you will be eligible for CSPA. Only at the time of interview the CO will determine your eligibility. Good luck.

PD becoming 'current' and 'become 24 years old' - means what?

In your post dated 26th Aug 2013 you made above statements. I want to know the meaning of them. Does that mean "PD appears in VISA Bulletin for interview schedule" and "completed age as on interview date" respectively or anything else?

            Eligibility Criteria

Must be the beneficiary of a pending or approved visa petition on or after August 6, 2002.
The beneficiary must not have had a final decision on an application for adjustment of status or an immigrant visa before August 6, 2002.
The child must “seek to acquire” permanent residence within 1 year of a visa becoming available. USCIS interprets “seek to acquire” as having a Form I-824, Application for Action on an Approved Application or Petition, filed on the child’s behalf or the filing of a Form I-485, Application to Register Permanent Residence or Adjust Status, or submit Form DS-230, Application for Immigrant Visa and Alien Registration from the Department of State. The date of visa availability means the first day of the first month a visa in the appropriate category was listed as available in the Department of State’s visa bulletin or the date the visa petition was approved, whichever is later.
